REGULAR MEETING

 

                                                                                                            April 1st, 1936

            A special meeting of the City Council of the City of Dover was held on the 1st day of April, 1936. The meeting was called to order by Mayor J. Wallace Woodford at 11:30 A. M. and on roll call the following members answered present: Messrs. LeFevre, Downes, Frear, Keith, Hinkle, Vane, Millman and Burton.

RESOLUTION

            On motion of Mr. Keith seconded by Mr. Downes the resolution following was put to a vote, and the roll being called the members of Council voted as follows:

            For the resolution: Messrs. LeFevre, Keith, Downes, Burton, Millman, Vane, Hinkle and Frear.

            Against the resolution: None.

            Thereupon the Chair declared that the said resolution had received the affirmative vote of more than three-fourths of all of the members elected to the Council.

            The resolution so adopted was as follows—

 

                        WHEREAS Section 50 of Chapter 158 of Volume 36 of the Laws of Delaware, being the charter of The City of Dover provides that “Whenever the needs of the City shall require more money than is at the time in the City treasury from current receipts, the Council shall be authorized and empowered to anticipate current revenue by borrowing such sum as shall be needed, not in excess of the sum of Fifty Thousand Dollars ($50,000.00) in any one year”, etc.

                        AND WHEREAS the present needs of The City of Dover require the expenditure of Fifty Thousand Dollars ($50,000) in excess of the funds in the City treasury a this time;

                        AND WHEREAS no other money has been borrowed for the needs of the City during the current year;

                        NOW THEREFORE BE IT RESOLVED as follows—

                        That the Council of The City of Dover borrow the sum of Fifty Thousand Dollars ($50,000) from the president, Directors and Company of the Farmers Bank of the State of Delaware for the purpose of supplying the City treasury with sufficient funds to meet the needs of the said City;

                        That the amount so borrowed shall be evidenced by the bond of The City of Dover executed by the Mayor and Treasurer under the corporate seal of the said City;

                        That the said bond shall be dated April 1, 1936, shall bear interest at the rate of three and one-half (3 ½ ) percentum per annum payable semi-annually, and shall be payable in installments of Ten Thousand Dollars ($10,000) a year with the option in The City of Dover to make payments on account of principal on the first day of April and October in any year in excess of the sum of Ten Thousand Dollars ($10,000) provided the said The City of Dover shall give to the said The President, Directors and Compnay of the Farmers Bank of the State of Delaware ninety days written notice of the amount it will pay on the first day of April and October next succeeding on account of the said principal debt;

            That the faith and credit of The City of Dover shall be deemed to be pledged by the said bond;

            That the said bond shall be in substantially the following form—

            KNOW ALL MEN BY THESE PRESENTS That The City of Dover, a municiapl corporation of the State of Delaware is held and firmly bound unto The President, Directors and Company of the Farmers Bank of the State of Delaware, a Corporation of the State of Delaware, in the sum of Fifty Thousand ($50,000) Dollars lawful money o fhte United States of America, to be paid to the said The President, Directors and Company of the Farmers Bank of the State of Delaware, its successors or assigns, as follows—the sume of Ten Thousand ($10,000) Dollars on the first day of October, 1936, the like sum of Ten Thousand ($10,000) Dollars on the first day of October 1937, the like sum of Ten Thousand ($10,000) on the first day of October, 1938, the like sum of Ten Thousand Dollars on the first day of October, 1939, and the like sum of Ten Thousand Dollars ($10,000) on the first day of October, 1940, together with interest at the rate of three and one-half ( 3 ½ ) percentum per annum payable on the first day of October and the first day of April each year whilst the said sum of Fifty Thousand ($50,000) Dollars or any part thereof remains unpaid; but the said The City of Dover to have the right, at its option, to make a payment on account of principal on the first day of April and October in any year in excess of the sum of Ten thousand ($10,000) Dollars provided the said The City of Dover shall give to the said The President, Directors and Company of the Farmers Bank of the State of Delaware ninety days written notice of the amount it will pay on the first day of April and October next succeeding on account of the said principal debt.

            This bond is issued under the authority of and in strict conformity with the provisions of Section 50 of Chapter 158 of Volume 36 of the Laws of Delaware being an act entitled “An Act Changing the Name of “The Town of Dover” to “The City of Dover” and Establishing a Charter Therefore” approved April 10, 1929.

            It is hereby certified and recited as follows – that the Council of The City of Dover did by resolution adopted April 1, 1936 (and which resolution received the affirmative vote of more than three-fourths of all the members of Council and was approved by the Mayor of said City) authorize the borrowing of the sum of Fifty Thousand ($50,000) Dollars; that the said sum was required for the needs of the said City and was the sum by which the funds in the City treasury were insufficient to fill the needs of the City; that the said Council has borrowed no other money for the needs of the City during the current year; that this bond is given to secure the said sum of Fifty Thousand ($50,000) Dollars borrowed by the said Council from The President, Directors and Company of the Farmers Bank of the State of Delaware for the purpose aforesaid.

            For the prompt payment of this bond, both principal and interest, as the same become due, the faith and credit of The City of Dover are hereby pledged.

            IN WITNESS WHEREOF The City of Dover has caused this bond to be signed by its Mayor and its Treasurer, under the corporate seal of the said City, this first day of April, 1936.

            KNOW ALL MEN BY THESE PRESENTS That The City of Dover, a municipal corporation of the State of Delaware is held and firmly bound unto The President, Directors and Company of the Farmers Bank of the State of Delaware, a corporation of the State of Delaware, in the sum of Fifty Thousand ($50,000) Dollars lawful money of the United States of America, to be paid to the said The President, Directors and Company of the Farmers Bank of the State of Delaware, its successors or assigns, as follows – the sum of Ten Thousand ($10,000) Dollars on the first day of October, 1936, and like sum of Ten Thousand ($10,000) Dollars on the frist day of October, 1937, the like sum of Ten Thousand ($10,000) on the first day of Octobe, 1938, the like sum of Ten Thousand Dollars on the first day of October, 1939, and the like sum of Ten Thousand Dollars ($10,000) on the first day of October, 1940, together with interest at the rate of three and one-half (3 1½ percentum per annum payable on the first day of October and the first day of April each year whilst the said sum of Fifty Thousand ($50,000) Dollars or any part thereof remains unpaid; but the said The City of Dover shall have the right, at its option, to make a payment on account of principal on the first day of April and October in any year in excess of the sum of Ten Thousand ($10,000) Dollars provided the said The City of Dove shall give to the said The President, Directors and Company of the Farmers Bank of the State of Delaware ninety days written notice of the amount it will pay on the first day of April and October next succeeding on account of the said principal debt.

RESOLUTION

            Upon motion of Messrs. Keith & Burton, the following resolution was unanimously passed by Council:

RESOLUTION OF CITY COUNCIL

CANCELLING ELECTION AND CONTINUING CHIEFS IN

OFFICE UNTIL NEXT REGULAR ELECTION

            WHEREAS, it has been brought to the attention of City Council that the date set for the annual election of chiefs of the Robbins Hose Company is in violation of the provisions of the city ordinance which designates a particular date on which such election shall be held; and

            WHEREAS, there are no contests for the several offices and nominations have been approved by Council;

            THEREFORE BE IT RESOLVED by the City Council of the City of Dover, in special meeting, held Wednesday, April 1st, 1936, that the election posted for Monday, April 6th, be and is hereby cancelled; and

            BE IT FURTHER RESOLVED that the Chief and Assistant Chiefs of the Robbins Hose Company now holding office be continued in office until the next regular election as designated by ordinance.

PERMIT FOR GASOLINE TANK

            Upon motion of Messrs. Keith and Downes, the City Council issued a permit to the Dover Gas Light Company to install a 100 gallon storage tank for gasoline with the understanding that it must be placed at least three feet under the ground.
