SPECIAL MEETING

March 28, 1927

Meeting was called to order at 7:30 P.M. by President Woodford, with the following members present: Messrs. Downes, LeFevre, Clements, Keith, Burton, Frear, Hinkle, and Clark.

Purpose of Meeting

The purpose of the meeting being to set a date to hold the election for a referendum vote on the $200,000 Street and Sewer Bond issue. The date being set for Monday the 18th day of April, 1927.

Members to hold election

Messrs. Thomas F. Clark and Thomas V. Keith together with the Alderman, Edwin F. Wood, were appointed by Mayor Woodford to hold the Election.

Notice of Election

The following notice and resolution upon motion of Messrs. Downes and LeFevre be published in the Delaware State News in the issues of March 31, and April 7. And the Clerk was instructed to have printed 25 notices of election and to be posted in various parts of the Town.

Resolution authorizing Bond issue

The following resolution was adopted by Council on motion of Messrs. Downes and Keith.

WHEREAS, the Town Council of “The Town of Dover” under and by virtue of an Act of the General Assembly of the State of Delaware entitled “An Act Authorizing the Town Council of “The Town of Dover” to borrow Two Hundred Thousand Dollars ($200,000) and to issue bonds therefore for the purpose of defraying the expenses incident to the improvement of the streets and the extension of the sewers and sewer system of “The Town of Dover” approved March 18, 1927, is authorized and empowered to borrow, upon the faith and credit of the said “The Town of Dover” a sum of money not exceeding Two Hundred Thousand Dollars ($200,000) and to issue bonds of the said “The Town of Dover” to be known as “Dover Street and Sewer Bonds Series of 1927 the year in which they are issued, to an amount not exceeding the said sum of Two Hundred Thousand Dollars ($200,000); said sum to be used for the purpose of the improvements of the streets and the extension of the sewers and sewer system of said Town;

AND WHEREAS Section 5 of said Act provides that all the moneys arising from the sale of said bonds shall be applied to carry into effect the provisions of said Act;

AND WHEREAS Section 10 of said Act provides, among other things, that before any bonds shall be issued under the provisions of said Act, a special election shall be held in the same place and in the same manner as other Town elections, and that notice of said election shall be given by advertisements published in at least one issue of a newspaper published in the Town of Dover at least two weeks before the day of such election, and printed notices of the election shall be posted in at least ten public places in said town at least two weeks before the holding of said election, which advertisements and notices shall state the time and place of the election and the amount of bonds proposed to be issued and the purpose for which the money is to be borrowed; and further provides that at said election every taxable paying Town taxes in said Town election, shall be entitled to vote, and shall have one vote for each dollar or fractional part of one dollar of taxes paid by such taxable according to the last assessment in said Town, and for the purpose of said election residence shall not be a qualification to voting in said Town; and further provides that if at such election a majority of votes cast shall be for the bond issue, then bonds to the amount voted on and not exceeding in the aggregate Two Hundred Thousand Dollars ($200,000) may be issued as in said Act provided, but if at such election the majority shall be against the bond issue, then no bonds shall be issued not money borrowed under said Act;

NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF “THE TOWN OF DOVER” IN REGULAR MEETING ASSEMBLED THIS TWENTY-EIGHT DAY OF MARCH, A.D. 1927;

First:- That it is deemed advisable that bonds as provided for in said Act of the General Assembly as set forth in the preamble hereof, to the aggregate amount of Two Hundred Thousand Dollars ($200,000) be issued.

Second:- That all moneys arising from the sale of such bonds shall be applied to carry into effect the provisions of the said Act, that is to say, for the purpose of defraying the expenses incident to the improvement of the streets and the extension of the sewers and sewer system of “The Town of Dover”.

Third:- That a special election beheld on Monday the 18th day of April, A.D. 1927, between the hours of one o’clock and four o’clock in the afternoon, in the same manner as other Town elections are held, in the Levy Court Room in the County Court House, Town of Dover, Kent County and State of Delaware, it being the same place for the holding of other Town elections, and that the Clerk of the Council be and he is hereby authorized to forthwith give notice by advertisements published in at least one issue of a newspaper published in the Town of Dover at least two weeks before the day of such election, and by posting printed notices of the election in at least ten public places in said Town at least two weeks before the holding of said election, and that said advertisements and notices shall state the time and place of the election and the amount of bonds proposed to be issued, and the purpose for which said money is to be borrowed.

Fourth:- That Thomas F. Clark and Thomas V. Keith two of the four members of the Council who held over, be and they are hereby chosen by the Council, who together with the Alderman, shall hold the said election.

Notice of Special Election

Upon motion, duly made by John P. LeFevre, seconded by W. D. Clements and carried, the following form of notice of special election was unanimously approved:

NOTICE OF SPECIAL ELECTION

WHEREAS the Town Council of “The Town of Dover” under and by virtue of an Act of the General Assembly of the State of Delaware entitled “And Act Authorizing the Town Council of “The Town of Dover” to borrow Two Hundred Thousand Dollars ($200,000) and to issue bonds therefore for the purpose of defraying the expenses incident to the improvement of the streets and the extension of the sewers and sewer system of “The Town of Dover” approved March 18th, A.D. 1927, is authorized and empowered to borrow, upon the faith and credit of the said “The Town of Dover” a sum of money not exceeding Two Hundred Thousand Dollars ($200,000) to be used for the purpose of defraying the expenses incident to the improvement of the streets and the extension of the sewers and sewer system of the said Town;

AND WHEREAS the Town Council of “The Town of Dover” at a regular meeting held on the twenty-eighth day of March, A.D. 1927, adopted the following resolution;

First:- That it is deemed advisable that bonds as provided for in said Act of the General Assembly as set forth in the preamble hereof, to the aggregate amount of Two Hundred Thousand Dollars ($200,000) be issued.

Second:- That all moneys arising from the sale of such bonds shall be applied to carry into effect the provisions of the said Act, that is to say, for the purpose of defraying the expenses incident to the improvement of the streets and the extension of the sewers and sewer system of “The Town of Dover.”

Third:- That a special election beheld on Monday the 18th day of April, A.D. 1927, between the hours of one o’clock and four o’clock in the afternoon, in the same manner as other Town elections are held, in the Levy Court Room in the County Court House, Town of Dover, Kent County and State of Delaware, it being the same place for the holding of other Town elections, and that the Clerk of the Council be and he is hereby authorized to forthwith give notice by advertisements published in at least one issue of a newspaper published in the Town of Dover at least two weeks before the day of such election, and by posting printed notices of the election in at least ten public places in said Town at least two weeks before the holding of said election, and that said advertisements and notices shall state the time and place of the election and the amount of bonds proposed to be issued, and the purpose for which said money is to be borrowed.

Fourth:- That Thomas V. Keith, and Thomas F. Clark two of the four members of the Council who held over, be and they are hereby chosen by the Council, who together with the Alderman, shall hold the said election.

NOW, THEREFORE, NOTICE IS HEREBY GIVEN that a special election will be held on Monday, the 18th day of April, A.D. 1927, between the hours of one o’clock and four o’clock in the afternoon, in the same manner as other Town elections are held, in the Levy Court Room in the County and State of Delaware, it being the same place for the holding of other Town election, for the purpose of deciding whether or not the Town Council of “The Town of Dover” shall issue bonds to the aggregate amount of Two Hundred Thousand Dollars ($200,000) as provided in said Act of the General Assembly, for the purpose of defraying the expenses incident to the improvement of the streets and the extension of the sewers and sewer system of the said “The Town of Dover.”

At said election every taxable paying Town taxes in said town and not delinquent in such payment at the time of the election shall be entitled to vote, and shall have one vote for each dollar or fractional part of one dollar of taxes paid by such taxable, according to the last assessment in said Town, and for the purpose of this election residence shall not be a qualification of voting in said town.

At the said election the ballots used shall have written or printed thereon the words “FOR THE BOND ISSUE” or the words “AGAINST THE BOND ISSUE.”

If at such election a majority of the votes cast shall be for the bond issue, then bonds to the amount voted on and not exceeding in the aggregate Two Hundred Thousand Dollars ($200,000) may be issued as in the said Act provided. But, if at such election, the majority shall be against the bond issue, then no bonds shall be issued nor money borrowed under the said Act.
