SPECIAL COUNCIL MEETING

A Special Council Meeting was held on November 18, 1991 at 5:30 p.m. with Council President Christiansen presiding. Members present were Councilmen Lambert, Daisey, Levitt, Pitts, Salters, Lynn, Weyandt and Hare.

Council staff members present were Chief Hutchison, Mr. Lucas, Mr. Worley, and Mrs. Boaman.

The Special Council Meeting was called specifically to discuss a possible amendment to the 1992 General Obligation Bond Issue Referendum Resolution.

By motion of Mr. Lynn, seconded by Mr. Daisey, Council unanimously approved the agenda.

Mr. Lynn moved that Council permit a presentation by Representative E. Stuart Outten. The motion was seconded by Mr. Daisey and unanimously carried.

REPRESENTATIVE E. STUART OUTTEN

Representative E. Stuart Outten informed members of Council that he is pledging $180,000 in State Suburban Street funds to be used towards the Greenway Project. This will allow the Greenway Project to be removed from the proposed 1992 General Obligation Bond Issue Referendum and will save the City taxpayers from having to fund the project.

Representative Outten explained that for the past several years he has been working on a road project on Bush Drive where residents have experienced a severe drainage problem. This was funded by monies he set aside from his State Suburban Street Funds. The State Department of Transportation has agreed to fulfill the funding for completion of this project, thereby freeing up Representative Outten's funds for other projects. Governor Michael Castle requested that legislators attempt to contribute some of their funds to the Greenway Project.

Although the Greenway Project is not entirely within his district, Representative Outten felt that the majority of the Greenway Project falls within his district and his funding of the project will help many constituents during these recessionary times.

Members of Council expressed their sincere appreciation for Representative Outten's generous pledge and for his continued support to the City of Dover.

Mr. Lynn moved for formal acceptance of the pledge of $180,000 for funding of the Greenway Project. The motion was seconded by Mr. Salters and unanimously carried.

Mr. Lynn moved to remove the Greenway Project from the proposed 1992 General Obligation Bond Issue Referendum. The motion was seconded by Mr. Weyandt and unanimously carried.

Mr. Karia submitted a Resolution amending the 1992 General Obligation Bond Issue Referendum Resolution (adopted November 12, 1991), which removes the Greenway Project from the Referendum Resolution.

Referring to the Schutte Park Project - Phase I, under "ball and multi-purpose fields", Mr. Lynn felt that the words "ball and" are confusing to the public who may confuse this with the plans of the Dover Little League. He moved that the Resolution be amended by striking the words "ball and", leaving the wording "multi-purpose fields". The motion was seconded by Mr. Weyandt and unanimously carried.

Mr. Weyandt moved to waive the full reading of the Resolution and to consider adoption by title only. The motion was seconded by Mr. Daisey and unanimously carried.

Mr. Lynn moved for approval of the amendment to the 1992 General Obligation Bond Issue Resolution, as amended. The motion was seconded by Mr. Salters and by a unanimous roll call vote, Council adopted the following Resolution:

RESOLUTION AMENDING THE RESOLUTION DIRECTING THE HOLDING OF A REFERENDUM AS TO THE ISSUANCE OF BONDS OF THE CITY OF DOVER FOR THE PURPOSE OF FINANCING CERTAIN CAPITAL IMPROVEMENTS FOR THE CITY OF DOVER.

WHEREAS, on November 12, 1991, the Mayor and Council approved a Resolution directing the holding of a referendum as to the issuance of bonds of the City of Dover for the purposes of financing certain capital improvements which capital improvements were specified in that Resolution (the "Bond Referendum Resolution"); and

WHEREAS, the Mayor and Council desire to amend the list of capital improvements to be included in the Referendum.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF DOVER, AS FOLLOWS:

1.  Section 9 of the Bond Referendum Resolution is hereby amended to delete the reference in second paragraph of the Notice of Bond Referendum to the "St. Jones Greenway".

2.  Section 11 of the Bond Referendum Resolution is hereby amended by deleting that Section and substituting in lieu thereof the following:

"11. The form of ballot and method of voting shall be as follows:

Bond costs represent the maximum financing cost for each project. If more than one project is approved, bond costs will decrease for each additional project.
