SPECIAL MEETING

January 4, 1965

A Special Meeting of City Council was held Monday, January 4, 1965 at 7:30 P.M. with Mayor Carroll presiding. Councilmen present were Messrs. Biggs, Harris, Hayes, Holpp, Hughes, Massey, Smith and Walls.

The meeting was called for the purpose of considering an amendment to the complaint of The City of Dover which is now before the Federal Power Commission. The amendment is a demand for overcharges made by DP&L for electric energy furnished Dover over the Lebanon-DAFB circuit from December, 1960 through April 1963. A reduction in Fuel Clause billings was granted to other Resale customers of DP&L which was not given to Dover. Under contract provision, Dover is entitled to benefit from reductions in the Resale rate. The refund claimed is $21,592.85 plus interest at 6%, which, calculated to December 31, 1964, makes the total claim $25,035.25.

On motion of Mr. Hayes, seconded by Mr. Smith, Council by unanimous vote adopted the following Resolution:

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:

That Spencer W. Reeder, Esq., attorney for The City of Dover in the case of City of Dover, Delaware v. The Delaware Power & Light Company, FPC Docket #E-7175, now pending before the Federal Power Commission, is hereby authorized to file with the Federal Power Commission the “Amendment to Complaint of The City of Dover, Delaware,” a copy of which is here to attached and made a part hereof.

Council adjourned at 8:10 P.M.
