SPECIAL MEETING

January 23, 1956

The special meeting of City Council was held Monday, January 23, 1956, at 7:30 P.M. with Mayor Haman presiding. Councilmen present were Messrs. Biddle, Davis, Helm, Holpp, Mundy, Petty, Tischer and Zartman.

MINUTES

Minutes of the last meeting were accepted as read.

REPORT OF ELECTION

The Election Board certified to City Council the following results of the municipal election and referendum held Monday, January 16, 1956.

                        For Mayor:                 W. Edward Haman                 563 votes

 

                         For Councilmen: 

                        First District:              Gilbert Mundy                        554 votes

                        Second District:          W. G. Davis                            554 votes

                        Third District:             Ralph R. Tischer                     296 votes

                                                            James P. Muir                         261 votes

                        Fourth District:           H. N. Helm                             238 votes

                                                            William A. Hayes                   323 votes

Referendum: To continue the present charter provisions for election of members of City Council: 462 votes

                      To revise the present charter provisions for election of members of City Council:

                      114 votes

REPORTS

Council accepted the report of budget expenditures and ambulance report for the month of December 1955.

Council accepted the published financial report of the City of Dover for the fiscal year ending June 30, 1955.

CITY HALL RENOVATION

Council accepted the recommendations of W. Ellis Preston, R.A. for award of contracts for renovation of City Hall and ordered the project tabled.

LIBRARY

The City Manager will confer with the Library Commission on the possibility of obtaining the space now used by the Library for City use.

SEWER POLICY

The City Manager discussed his study of a sewer policy for the City and will furnish each member of Council with a written copy of his recommendations.

NEW STREET

The City Solicitor reported on his efforts to obtain right-of-way for New Street from Dover to South Streets. He will prepare deeds and attempt to have the land conveyed to the City without cost.

RESOLUTION

By unanimous vote, Council adopted the following resolution:

A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A STIPULATION EXCLUDING CERTAIN LANDS OF THE CITY OF DOVER FROM CONDEMNATION PROCEEDINGS NOW PENDING IN THE FEDERAL DISTRICT COURT.

WHEREAS the United states of America has commenced proceedings in the Federal District Court for the District of Delaware to condemn certain lands of Christian H. Zimmerman and other, said proceedings being designated as Civil Action No. 1722; and

WHEREAS the lands described in the Government’s complaint filed in said proceeding erroneously include a certain parcel of land owned by the City of Dover; and

WHEREAS the Government now desires to exclude and release the said parcel of land of The City of Dover from the aforesaid condemnation proceedings, and The City of Dover desires to release the United States of America from any claim for damages arising from the erroneous inclusion of te parcel of land owned by the City as aforesaid;

NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF DOVER

That the City Manager is hereby authorized and fully empowered to execute on behalf of The Cit of Dover, deliver to the proper representatives of the United States of America, and file in the united States District Court for the District of Delaware a stipulation whereby the Government agrees to exclude the parcel of land owned by The City of Dover from the lands to be taken and condemned in a certain condemnation proceeding entitled “United States of America, Plaintiff, vs. 120.0 Acres of Land in Kent County, Delaware, and Christian H. Zimmerman et al., Defendants,” being Civil Action No. 1722 in said Court, and The City of Dover released the United States of America from all liability for damages or otherwise arising from the erroneous inclusion of the City land in the description of the lands to be condemned.

ORDINANCE

By unanimous vote, Council passed the following ordinance;

AN ORDINANCE PROVIDING SPECIAL PENALTIES FOR VIOLATIONS OF THE PARKING METER ORDINANCE OF THE CITY OF DOVER

Be It Ordained By The Council Of The City Of Dover:

Section 1. The ordinance adopted November 10, 1947, entitled “An Ordinance Providing For The Leasing and Installation Of Parking Meters; Providing For and Regulating The Parking On Certain Street; Authorizing The Use Of Parking Meters Therefore; And Providing Penalties For the Violation Thereof”, is hereby amended by adding at the end thereof a new Section, as follows:

Section 10. Any police officer who discovers a vehicle parked overtime as indicated by the parking meter installed at the parking space where said vehicle shall be found shall firmly attach to said vehicle in a plainly visible position thereon a notice of such offense, upon which shall be noted the hour and minute if placing such notice thereon. Any operator or owner of a vehicle upon which such a notice shall be placed may fully discharge all his responsibility for the offense of overtime parking as aforesaid by delivering the said notice together with the sum of Ten Cants ($0.10) to an agent or employee of The City Of Dover either at the City Hall or at the City Police Station within one hour of the time noted upon said notice.
