SPECIAL MEETING
November 17, 1952
The special meeting of City Council was held Monday, November 17, 1952, at 7:30 P.M. with Mayor Haman presiding. Councilmen present were Messrs Davis, Helm, Holpp, Mundy Petty, Smith and Tischer.
By unanimous vote, Council adopted the following ordinance:
AN ORDINANCE REPEALING AN ORDINANCE ADOPTED JUNE 30, 1949, PROVIDING FOR THIS PAYMENT OF PENSION BENEFITS TO CERTAIN CITY EMPLOYEES.
Be It Ordained By The Council Of The City Of Dover In Council Met:
Section 1. The ordinance adopted June 30, 1949, entitled “AN ORDINANCE PROVIDING FOR THE PAYMENT OF PENSION BENEFITS TO CERTAIN CITY EMPLOYEES, FIXING AGES OF RETIREMENT, ESTABLISHING BENEFITS PAYABLE, AND THE SOURCE OF PAYMENT THEREOF, PROVIDING FOR APPLICATIONS FOR PENSIONS, AND THE PROCEDURE TO BE FOLLOWED WITH RESPECT THERETO, PROVIDING THAT PENSION BENEFITS SHALL BE FREE OF ATTACHMENTS AND NON ASSIGNABLE, AND ALSO PROVIDING FOR THE REDUCTION OF BENEFITS UNDER CERTAIN CONDITION” is hereby repealed.

By unanimous vote, Council adopted the following ordinance:
AN ORDINANCE DECLARING THE POLICY AND PURPOSE OF THE CITY OF DOVER, DELAWARE, TO EXTEND TO THE EMPLOYEES AND OFFICIALS OF SAID CITY OF DOVER, NOT TO EXCLUDE BY LAW OR BY THIS ORDINANCE, THE BENEFITS OF THE SYSTEMS OF FEDERAL OLD AGE AND SURVIVOR’S INSURANCE, AS AUTHORIZED BY THE FEDERAL SOCIAL SECURITY ACT, AND AMENDMENTS THERETO, UPON THE BASIS OF APPLICABLE STATE AND FEDERAL LAWS OR REGULATIONS: AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AGREEMENTS AND AMENDMENTS THERETO WITH THE STATE AGENCY AUTHORIZED TO ENTER INTO SUCH AGREEMENTS, FOR COVERAGE OF SAID EMPLOYEES AND OFFICIALS: PROVIDING FOR WITHHOLDINGS FORM SALARIES AND WAGES OF EMPLOYEES AND OFFICIALS OF SAID CITY SO COVERED TO BE MADE AND PAID OVER AS PROVIDED BY APPLICABLE STATE OR FEDERAL LAWS OR REGULATIONS: PROVIDING THAT SAID CITY SHALL KEEP RECORDS AND MAKE REPORTS AS REQUIRED BY APPLICABLE STATE OR FEDERAL LAWS OR REGULATIONS: EXCLUDING FROM THIS ORDINANCE ANY AUTHORITY TO MAKE ANY AGREEMENT WITH RESPECT TO ANY POSITION, EMPLOYEE, OR OFFICIAL NOW COVERED OR AUTHORIZED TO BE COVERED BY ANY OTHER ORDINANCE OR LAW CREATING ANY RETIREMENT SYSTEM FOR ANY EMPLOYEE OR OFFICIAL OF SAID CITY: AND FURTHER PROVIDING FOR THE EXCLUSION OF CERTAIN GROUPS TO BE EXCLUDED BY APPROPRIATE STATE OR FEDERAL LAW.
Be It Ordained By The Council Of The City Of Dover In Council Met:
Section 1. It is hereby declared to be the policy and purpose of the City of Dover, Delaware, to extend, effective as of January 1, 1952, to the employees and officials thereof, not excluded by law or by this ordinance, the benefits of the system of Old Age and Survivor’s Insurance as authorized by the Federal Social Security Act and amendments thereto, including Public Law 734 of 81st Congress. In pursuance of said policy, and for that purpose, the City shall take such action as may be required by applicable State or Federal laws or regulations.
Section 2. The Mayor of the City of Dover, Delaware, is hereby authorized and directed to execute all necessary agreements and amendments thereto with the State Tax Department, the State Agency authorized to act to secure coverage of employees and officials as provided in Section 1 hereof.
Section 3. Withholdings from salaries or wages of employees and officials for the purpose provided in Section 1 hereof are hereby authorized to be made in the amounts and at such times as may be required by applicable Federal laws or regulations and by regulations of the State Tax Department in force or hereafter promulgated or amend by the State Tax Department and shall be paid over to the State Tax Department.
Section 4. There shall be appropriated from any available funds such amounts at such times as may be required by applicable Federal laws or regulations and by regulations of the State Tax Department now in force or hereafter promulgated or amended by the State Tax Department for employer’s contributions, which shall be paid over to the State Tax Department.
Section 5. The City shall keep such record and such reports as may be required by applicable Federal laws or regulations or by regulations of the State Tax Department now in force or hereafter promulgated or amended.
Section 6. There is hereby excluded from this ordinance any authority to make any agreement with respect to any position or any employee or official now covered, or authorized to be covered, by any other ordinance or law creating any retirement system for any employee or official of the said City.
Section 7. The City of Dover, Delaware does hereby adopt the terms, conditions, requirements, renovations, benefits, privileges, and other conditions thereunto appertaining, of Title II of the Social Security Act as amended by Public Law No. 734, 81st Congress, for and on behalf of all the officers and employees thereof, save and except any of such officers and employees now covered or authorized to be covered by any retirement system provided by law, and further excepting any official or employee who occupies any position, office, or employment not authorized to be covered by applicable State or Federal laws or regulations.
Section 8. This ordinance shall take effect upon its approval as required by law.

Council authorized the payment of Social Security withholdings due from employees and from the City beginning January 1, 1952 thru the beginning of payroll deductions form the General Fund of the City. Employee deductions will be refunded by employees in not more than a six month period.
FOUNTAIN DRIVEWAY
Council authorized Charles Fountain to depress eight feet of curb at 428 S. Governors Avenue for the purpose of installing a driveway.
HYNSON SEWER
Council authorized Charles Hynson to connect to the City owned sewer line running from the City Housing Project, providing connection fees and sewer rents paid.
PAY OF FIRE HOUSE CUSTODIANS
Council authorized an increase in the pay of Fire House Custodians from $52.50 to $57.50 per week.
AMENDMENT TO TRAILER ORDINANCE
By unanimous vote, Council adopted the following ordinance:
AN ORDINANCE AMENDING AN ORDINANCE RELATING TO TRAILERS, PASSED DECEMBER 13, 1948.
Be It Ordained By The Council Of The City Of Dover In Council Met:
Section 1. That the ordinance relating to trailers passed December 13, 1948, be and the same is hereby amended by striking out Section 1 of the said ordinance and enacting in lieu thereof the following:
Section 1. No person, firm, association, or corporation being the owner of, tenant of, or in possession of any trailer, bus, motor vehicle, or portable structure or vehicle of any kind designed or adapted for occupancy, either as a dwelling or as a place of business, and with or without wheels, shall park, place, set or install the same upon any land within the limits of the City of Dover without first obtaining a permit therefor from the Council of the City of Dover.
