REGULAR MEETING

                                                                                                                        May 10th, 1943

            The Regular Meeting of the City Council of the City of Dover was held on the 10th day of May, 1943. The meeting was called to order by Mayor Woodford at 7:30 P. M., and on roll call the following members answered “PRESENT”: Messrs. LeFevre, Downes, Millman, Keith, Burton, Vane and Hinkle.

MINUTES

            Upon motion of Messrs. Burton and Hinkle, the reading of the minutes of the last regular meeting was dispensed with.

CITY MANAGER’S REPORT

            The City Manager’s report for the month of April was read by the Clerk and accepted upon motion of Messrs. Keith and Burton. Upon motion of Messrs. LeFevre and Hinkle, the City Manager was instructed to prepare the proper notices in order to pay off $75,000 worth of City Bonds at our next regular interest date; namely, July 1st, 1943.

FINANCIAL REPORT

            The financial report for the month of April was read by the Clerk and accepted upon motion of Messrs. Keith and Burton.

ALDERMAN’S REPORT

            The Alderman’s report for the month of April was read by the Clerk and accepted upon motion of Messrs. Burton and Vane. A check amounting to $173.05 was turned over to the City Manager with the report of 28 arrests.

POLICE REPORT

            The report of the Chief of police was read by the Clerk and approved upon motion of Messrs. Hinkle and Burton.

ORDINANCES

            The following ordinance entitled, “AN ORDINANCE REGULATING AND LIMITING THE USE OF CERTAIN STREETS IN THE CITY OF DOVER BY TRUCKS AND OTHER HEAVY DUTY VEHICLES,” was passed by the following vote of the Council:

                        Messrs.           Downes, yes;

                                                Keith, yes;

                                                LeFevre, yes;

                                                Burton, yes;

                                                Vane, yes;

                                                Hinkle, yes;

                                                Millman, yes;

AN ORDINANCE REGULATING AND LIMITING THE USE OF CERTAIN STREETS IN THE CITY OF DOVER BY TRUCKS AND OTHER HEAVY DUTY VEHICLES

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:

            SECTION 1.   The City Manager is hereby authorized and directed to designate which street or streets, lanes or alleys of the City of Dover shall be available for the use of trucks and other heavy duty motor vehicles. In determining what streets are to be so used the City Manager shall take into consideration among other factors to be considered in making such determination the amount of traffic normally passing over such street, lane or alley, the type of surface or covering of the roadbed, the season of the year, the total weight of the vehicle and load, the type of tire used on such vehicle, and such other factors as may be proper in the determination of the type and amount of traffic which any street, lane or alley is able to carry under the existing conditions.

            SECTION 2.   Whenever the City Manager shall determine that the type of traffic over any street, lane or alley should be regulated or limited, then the said City Manager shall post signs at the intersection of such street or streets, lanes or alleys with any other street or streets, lanes or alleys, and which sign shall clearly designate the type of traffic permitted to use such street, lane or alley, the total weight of any vehicle, including load, which will be permitted to use such street, lane or alley, and such other information as the City Manager may deem proper.

            SECTION 3.   The City Manager is hereby authorized and empowered to designate any street or streets which may be used by heavy duty trucks or other vehicles passing through the City of Dover or over, across or upon the streets of the said City of Dover.

            SECTION 4.   Whenever the City Manager shall determine that the condition of any street, lane or alley is such that the traffic over the same should be regulated or limited s to size and type of vehicle or vehicles using the same, the siad City Manager shall post signs at the intersection of such street, lane or alley setting forth the type of traffic, the type of vehicle, the total weight of vehicle, together with load, and the type of wheel or tire which can be permitted touse the same. It shall be unlawful for any vehicle not included in the class or classes permitted, to use such street, lane or alley so regulated contrary to the provision of such signs or notices.

            SECTION 5.   Said City Manager shall have the right to call to his assistance any agency or employee of the State Highway Department or any other road building or construction agency or contractor experienced in building and maintaining roads and highways to advise the City Manager as to the type and size and weight of any vehicles or vehicles which can safely use any street, lane or alley of the City of Dover without unduly damaging the same.

            SECTION 6.   Any person who shall operate any motor vehicle over, upon or acrossany of the streets, lanes or alleys of the City of Dover contrary to the provisions of this ordinance shall, upon conviction thereof, be fined not less than Ten ($10.00) Dollars or more than One Hundred ($100.00) Dollars for each separate offense, and the owner of any vehicle or vehicles using any of the streets, lanes or alleys contrary to the provisions of this ordinance or of any of the regulations herein provided for, shall be responsible for any damage or damages caused by the use of the vehicle or vehicles over any street, lane or alley.
