REGULAR MEETING

                                                                                                July 11, 1938

            The regular meeting of the City Council of the City of Dover was held on the 11th day of July, 1938. The meeting was called to order by Mayor Woodford and on roll call the following members answered present: Messrs. Millman, Frear, Burton, Hinkle and Vane.

MINUTES

            Upon motion of Messrs. Burton and Vane, the reading of the minutes of the last regular meeting was dispensed with.

CITY MANAGER’S REPORT

            The City Manager’s report for the month of June was read by the Clerk and accepted upon motion of Messrs. Hinkle and Burton.

            Upon motion of Messrs. Hinkle and Frear, the City Manager voted to accept the offer of the United States Government for PWA grant for the purpose of building an interceptor sewer to take care of the Tar Ditch section of the City of Dover and authorized the proper officials of the City Council to execute the necessary papers for this acceptance.

RESOLUTION NO. 100.

A RESOLUTION ACCEPTING THE OFFER OF THE UNITED STATES TO THE CITY OF DOVER TO AID BY WAY OF GRANT IN FINANCING THE CONSTRUCTION OF AN INTERCEPTOR SEWER

Be it resolved by the City of Dover:

            SECTION 1.   That the offer of the United States of America to the City of Dover to aid by way of grant in financing the construction of an interceptor sewer, a copy of which offer reads as follows:

1.         Subject to the Terms and Conditions (PWA Form NO. 230, as amended to the date of this offer) which are made a part hereof, the United States of America hereby offers to aid in financing the construction of extensions and improvements to the to the existing sewer system, including the acquisition of necessary land and rights of way therefor (herein called the “Project”), by making a grant to The City of Dover (herein called the “Applicant”), in the amount of 45 per cent of the cost of the Project upon completion, as determined by the Federal Emergency Administrator of Public Works, but not to exceed, in any event, the sum of $18,315.

2.         By acceptance of this offer the applicant covenants to begin work on the project as early as possible, but in no event later than 8 weeks from the date of this offer and to complete such project with all practicable dispatch, and in any event within 8 months from the commencement of construction.

Be and the same is hereby in all respects accepted.

            SECTION 2.   That said City of Dover agrees to abide by all the Terms and Conditions of said offer, including the Terms and Conditions of said offer, including the Terms and Conditions annexed thereto and made a part thereof.

            SECTION 3.   That the City of Dover be and is hereby authorized and directed forthwith to send to the Federal Emergency Administration of Public Works three certified copies of the proceedings of the City Council in connection with the adoption of the Resolution, setting forth this Resolution in full, and such further documents or proofs in connection with the acceptance of said offer as may be requested by the Federal Emergency Administration of Public Works.

            The above resolution was seconded by Mr. Grover C. Frear and was adopted, with the following voting aye: Messrs. Millman, Frear, Burton, Hinkle and Vane, and the following voting nay: None.

            The chair thereupon declared said Resolution carried and the Mayor thereupon signed said Resolution in approval thereof.

CERTIFICATE OF CLERK

            I, Joseph O. Willis, the duly elected, qualified and acting City Clerk of the City Council of the City of Dover, do hereby certify that the attached copy of the extracts of the minutes of a regular meeting of the City Council of the City of Dover held on the 11th day of July, 1938, is a true, correct, and conpared copy of the original minutes of said meeting on file and of record, and I do further certify that the copy of the Resolution appearing in such minutes, entitled “A RESOLUTION ACCEPTING THE OFFER OF THE UNITED STATE TO THE CITY OF DOVER TO AID BY WAY OF GRANT IN FINANCING THE CONSTRUCTION OF AN INTERCEPTOR SEWER,” is a true, correct, and compared copy of the original Resolution adopted at said meeting, which Resolution is on file and of record.

            WITNESS may hand and the seal of the said City of Dover this 11th day of July, 1938.

            Upon motion of Messrs. Burton and Hinkle, the following Wage Scale was adopted by the City Council for PWA Project #Del. 1023:

RESOLUTION FIXING MINIMUM WAGE RATES ON DEL. 1023 PROJECT

            I, Joseph O. Willis, being the duly appointed, qualified and acting City Clerk of he City of Dover, do hereby certify that the following resolution was regularly passed and adopted by the City Council of the City of Dover at a regular meeting thereof held on the 11th day of July, 1938.

            WHEREAS, a thorough investigation has been made of the hourly wage rates which are being paid in the City of Dover which is the locality in which the proposed project (hereinafter referred to as “Project”) is to be constructed by the City of Dover, to employees in each trade or occupation engaged in work of a nature similar to the work to be performed in the construction of said Project, and the prevailing hourly wage rates being paid in such locality to such employees for such work have been determined by the City Manager. These rates were determined by wages paid by contractors and others in the City of Dover. They are minimum and are frequently much higher in the scales paid.

            NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Dover that the following rates for the respective trades or occupations listed below shall be and are hereby fixed as the minimum hourly wage rates and have been determined in accordance with rates prevailing for work of a similar nature in the locality in which the project is to be constructed:

                        BE IT FURTHER RESOLVED that the foregoing list of trades or occupations includes to the best of our knowledge, all the classifications of employees who will be engaged in work on said Project other than executive , supervisory, administrative, clerical or other nonmanual workers as such.

            BE IT FURTHER RESOLVED that there be transmitted wit this resolution the substantiating data upon which the foregoing determination is based.

            I FURTHER CERTIFY that the foregoing resolution is on file and of record in my office as City Clerk of the City of Dover.

FINANCIAL REPORT

            The financial report for the month of June was read by the Clerk and accepted and approved upon motion of Messrs. Burton and Millman.

ALDERMAN’S REPORT

            The Alderman’s report for the month of June was read by the Clerk and accepted upon motion of Messrs. Burton and Hinkle. A check amounting to $16.00 was turned over to the City Manager with the report of 7 arrests.

 

POLICE REPORT

            The report of the Chief of Police was read by the Clerk and accepted upon motion of Messrs. Burton and Frear.

RESOLUTION

COPY OF MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF DOVER JULY 11, 1938, RELATING TO THE BORROWING OF $25,000 FROM FARMERS BANK OF THE STATE OF DELAWARE.

On motion of Mr. Grover C. Frear seconded by Mr. W. M. Hinkle the resolution following was put to a vote, and the roll being called the members of Council voted as follows:

For the resolution: Messrs. Burton, Millman, Vane, Hinkle and Frear.

Against the resolution: None.

Thereupon the Chair declared that the said resolution having received the affirmative vote of every member elected to the Council was duly adopted. 

The resolution so adopted was as follows—

WHEREAS Section 50 of Chapter 158 of Volume 36 of the Laws of Delaware, being the charter of The City of Dover provides that “When ever the needs of the City hall require more money than is at the time in the City treasury from current receipts, the Council shall be authorized and empowered to anticipate current revenue by borrowing such sum as shall be needed, not in excess of the sum of Fifty Thousand Dollars ($50,000.00) in any one year,” etc.

AND WHEREAS the present needs of The City of Dover require the expenditure of twenty-five thousand dollars ($25,000.00) in excess of the funds in the City treasury at this time;

AND WHEREAS no other money has been borrowed for the needs of the city during he current year;

NOW THEREFORE BE IT RESOLVED as follows: - -

That the Council of The City Dover borrow the sum of twenty five thousand dollars ($25,000.00) from The President, Directors and Company of the Farmers Bank of the State of Delaware for the purpose of supplying the City treasury with funds to meet the needs of the said City;

That the amount so borrowed shall be evidenced by the bond of The City of Dover executed by the Mayor and Treasurer under the corporate seal of the said City;

That the said bond shall be dated as of the day when the money is borrowed, and shall bear interest at the rate of three and one-half (3 ½ ) percent per annum and shall mature on the first day of December, 1938;

That the faith and credit of The City of Dover shall be deemed pledged for the payment of said bond both principal and interest;

That the said bond shall be in substantially the following form—

KNOW ALL MEN BY THESE PRESENTS That The City of Dover, a municipal corporation of the State of Delaware is held and firmly bound unto The President, Directors and Company of the Farmers Bank of the State of Delaware, a Corporation of the State of Delaware, in the sum of twenty-five thousand ($25,000.00) dollars lawful money of the United States of America, to be paid to the said The President, Directors and Company of the Farmers Bank of the State of Delaware, its successors or assigns on the first day of December, 1938, together with interest thereon at the rate of three and one-half 3 ½ percent per annum.

This bond is issued under the authority of an in strict conformity with the provisions of Section 50 of Chapter 158 of Volume 36 of the Laws of Delaware being an act entitled “AN ACT CHANGING THE NAME OF “THE TOWN OF DOVER” TO “THE CITY OF DOVER” AND ESTABLISHING A CHARTER THEREOFR” approved April 10, 1929.

It is hereby certified and recited as follows—that the Council of The City of Dover did by resolution adopted July 11, 1938, (and which resolution received the affirmative vote of more than three-fourths of all the members of Council and was approved by the Mayor of said City) authorize the borrowing of the sum of twenty-five thousand ($25,000.00) dollars; that he said sum was required for the needs of the said City and was the sum by which the funds in the City treasury were insufficient to fill the present needs of the City; that the said Council has borrowed no other money for the needs of the City during the current year; that this bond is given to secure the said sum of twenty-five thousand ($25,000.00) dollars borrowed by the said Council from The President, Directors and Company of the Farmers Bank of the State of Delaware or the purpose aforesaid.

For the prompt payment of this bond, both principal and interest, as the same become due, the faith and credit of The City of Dove are hereby pledged.

IN WITNESS WHEREOF The City of Dover has caused this bond to be signed by its Mayor and its Treasurer, under the corporate seal of the said City, this of July, nineteen hundred and thirty eight.

                                    CLERK OF THE COUNCIL OF THE CITY OF DOVER

LETTERS

            A letter from the executive officer of the Mosquito Control Commission of the State of Delaware, Mr. W. S. Corkran, was read to the City Council asking for financial aid in carrying out the mosquito control program within the vicinity of Dover. After some discussion, Council instructed the City Manager to get in touch with Mr. Corkran and find out just where this expenditure would be made and ascertain if it would be used for the immediate vicinity of the City. If this be the case, the City Manager was authorized to make an expenditure of not more than $300.00 for this purpose

            A letter from the Secretary of the Dover Library Commission asking for a renewal of the City’s annual donation to the library was read by the Clerk, and upon motion of Messrs. Burton and Hinkle, Council voted to donate $250.00 which is the usual annual appropriation to the same.

COMMITTEES

            A Committee appeared before Council from DuPont Street complaining of the building activities of Wm. Hurley, Sr., in that location. After some discussion, Council informed them that the matter would be looked into and the proper building regulations would be carried out in the future.

            Council adjourned at 8:15 P.M.
